Were there only nine fines last year in Paris, as Ian Brossat claims?

The rental framework in force in Paris since 2019, but also in Lille, and soon Bordeaux or even Montpellier has had positive effects in the capital, according to the deputy mayor of Paris, Ian Brossat, interviewed on Tuesday, December 7 on France Inter. As a reminder, this device imposes a maximum amount on owners to set their rent. Ian Brossat, also campaign director of the Communist presidential candidate, assures us that this device would work better with more controls and sanctions.

“There are a certain number of owners, a little more than a third, who continue to practice excessive rents (…) because there are not enough controls and not enough sanctions. last year, the prefect of Paris pronounced 9 fines of 1,500 euros “, argued the chosen one.

Ian is right to say that there have been very few fines imposed on landlords who do not respect the rent regulations. In 2020, there were even only 5 according to the prefecture, 10 in total since the launch of the device in 2019. And this, while indeed a third of Parisian rents are out of the nails. According to a recent study by the Abbé Pierre Foundation, out of 15,000 rents examined in Paris, 35% are above the legal ceiling: 200 euros too much on average.

This difference between the number of illegal rents and the number of fines imposed is primarily due to the low number of reports. It is up to the tenants to come forward in the event of non-compliant rent. They can apply to the Departmental Conciliation Commission or directly to the Prefect via the housing service of the DRIHL (Regional and Interdepartmental Directorate of Accommodation and Housing). However, as of December 8, the CDC had only had to deal with 185 cases deemed admissible. The Prefect was only referred to him for 98 cases (some of which may also have been passed beforehand by the CDC).

In addition, out of the 185 cases handled by the CDC, 150 have in some way been resolved. “amicably”, in favor of the tenant. The fine can only be pronounced within the framework of the administrative procedure initiated with the prefect, without being automatic. “The administrative sanction procedure as provided for by the ELAN law and its implementing decree is in no way intended to impose a systematic fine on all donors. It is a question of sanctioning only those donors who refuse to regularize the amount of rent and / or reimbursement of sums unduly received “, explains the Paris prefecture.

In fact, out of the 98 cases investigated by the prefect, “61 were classified taking into account the regularization of the lease in favor of the tenant and 10 fines were pronounced against the lessors”, details the prefecture. In the vast majority of cases, the owners therefore brought themselves into compliance before the prefect needed to impose a fine, that is to say that he lowered the rents and / or reimbursed the overpayments.

Donors who do not obey the formal notices risk a fine of 5,000 euros for individuals, 15,000 euros for legal persons.
