The Federal Court of Appeal quashes the decision of the CRTC which had upheld a complaint last year, blaming Radio-Canada for having broadcast the n-word on the air in a radio chronicle.
The federal agency accused the Crown corporation of having unduly offended its audience during an interview during which the title of a book by Pierre Vallières – which includes an offensive and racist word, specifies the Court of Appeal — had been pronounced several times.
The CRTC exceeded its jurisdiction in making this decision, the Federal Court of Appeal ruled in its judgment rendered Thursday, adding that it also failed to adequately consider the right to freedom of expression.
The file was thus returned to the CRTC so that it could rule again on the merits of the complaint, “after having duly weighed the impact that its decision could have on the freedom of expression of the Société Radio-Canada”, is – he writes in the judgment.
