The president of the La France Insoumise group in the National Assembly announced on Thursday that the Constitutional Council would be referred to the resigning ministers who are also serving as MPs.

“This is not a new blow, it is a way of putting an end to a situation which is in violation of the separation of powers,” says Mathilde Panot, president of the La France insoumise group in the National Assembly, on franceinfo Friday August 30. The Val-de-Marne MP announced on X on Thursday that she would refer the matter to the Constitutional Council to denounce the fact that resigning ministers are also exercising the function of MP.

This referral to the Constitutional Council, “This is a way of putting an end to a situation which is in total violation of Article 16 of the Declaration of the Rights of Man and of the Citizen on the question of the separation of powers.” The Val-de-Marne MP recalls that “in the Constitution, a minister does not have the right to be a deputy at the same time”. There are 17 ministers from the resigning government, including Prime Minister Gabriel Attal, who were elected as deputies during the legislative elections of June 30 and July 7, combining the two functions.
“Gabriel Attal sits in the conference of presidents [de groupes à l’Assemblée] and decides on the legislative agenda in the Assembly, while he is the resigning Prime Minister”denounces the president of the LFI group. “The longer it goes on, the more absurd this situation becomes,” she believes. “When we look at this resigning government, it looks more and more like a fully functioning government.”adds Mathilde Panot, who specifies that since July 16, “1,300 decrees and orders” were published in the Official Journal.
