(Washington) A Colorado court on Friday rejected a request to exclude the name of Donald Trump, charged with federal insurrection, from the ballots in the Republican primaries for the 2024 US presidential election in that state.
The decision by the district judge in this western US state, Sarah Wallace, follows similar judgments in Minnesota and Michigan, which also decreed to leave the name of the former president on the ballots.
“The Court orders the Secretary of State to place Donald J. Trump on the presidential primary ballot when he certifies the ballot on January 5, 2024,” Mr.me Wallace in his decision.
This is a new victory for Donald Trump, whose name has not been removed from any ballot despite the legal proceedings piling up against him.
In the complaint it filed in Colorado, the NGO Citizens for Responsibility and Ethics (CREW) believes that Donald Trump is ineligible because of the assault on the Capitol led by his supporters on January 6, 2021.
This violent attack on the seat of Congress, the reputedly inviolable sanctuary of American democracy, to prevent the certification of Joe Biden’s victory in the 2020 presidential election, stunned the United States and beyond.
Donald Trump’s trial in the case will begin in March in Washington.
Other similar legal actions in other states could lead to raising the question of Donald Trump’s electability before the Supreme Court, where conservatives however have a 6-3 majority.
The invocation of this ineligibility, which strongly divides jurists, is based on article 3 of 14e amendment to the Constitution prohibiting any person from holding public office if he or she has engaged in “insurrection.”
