Psychiatrist Pierre Mailloux has once again failed in his attempt to take his case to the Supreme Court.

The highest court has indeed refused, Thursday, to hear the appeal of a decision of the Superior Court, which had rejected a lawsuit of just over 10 million that the psychiatrist wanted to bring against the College of Physicians, decision subsequently upheld by the Court of Appeal.
“Doc Mailloux”, a controversial media personality, was seeking compensation for the relentlessness of which he said he was the victim on the part of his professional order in connection with disciplinary complaints relating to ethical issues.
In February 2021, Judge Robert Dufresne, of the Superior Court, agreed with the College of Physicians who asked him to dismiss the lawsuit. Judge Dufresne considered that the psychiatrist’s action was abusive.
The magistrate had also determined that the lawsuit had no chance of success given the immunity enjoyed by the syndic of the College and the absence of allegations of bad faith.
Moreover, he argued that the matter had exceeded the limitation periods and that Dr. Mailloux had not established that the delays had been caused by an impossibility to act.
In May 2021, the Court of Appeal refused to hear the case and dismissed the motion for leave to appeal. The bench of three judges had concluded that Judge Dufresne had made no error of law and no error in the assessment of the facts.
This is the second time that the highest court has refused to hear the psychiatrist. In November 2017, the Supreme Court had also maintained by a similar refusal, a decision of the Court of Appeal, which had itself ratified a decision of the Tribunal des professions which, too, had endorsed with a few nuances a decision of the Disciplinary Board of the College of Physicians.
In other words, the psychiatrist had failed four times to have his disbarment overturned linked to a series of disciplinary infractions, some of which related to his controversial remarks targeting black people on the show. Everybody talks about itin 2005.
He was also fined $20,000.
