Hamza Mbareche will long regret his evening of March 5, 2018. The man, who holds several diplomas and who aspired to become a teacher, had accompanied his spouse at the time and a work colleague to the bars to party.

However, during the evening, the intoxicated victim had difficulty standing. The couple had then made the decision to take her home to take care of her.

DNA confirms

Vomiting repeatedly, the 29-year-old woman had been lying on the couch. Then, Mbareche had proposed to his wife to go to sleep while he took care of the victim.

This is when a full sexual assault took place.

DNA evidence had been found on the victim, leaving no doubt of a full and unprotected sexual relationship.

The 36-year-old had pleaded mutual consent, but Judge Christian Boulet ruled that the victim’s consent could not be valid.

A sentence of 26 months’ imprisonment was therefore ordered. The defendant’s lawyer, Me Stéphanie Pelletier-Quirion, has already appealed the verdict.
