As riots continue in New Caledonia over the constitutional reform project, Emmanuel Macron decided to declare a state of emergency on Wednesday May 15.
In exceptional circumstances, exceptional regime. The state of emergency has just come into force at 8 p.m. in New Caledonia. The main measures of this exceptional regime allow the minister, the prefect and the commissioner for New Caledonia to restrict freedoms, for example the ban on demonstrations, the closure of public places, house arrest or administrative searches.
“It is a kind of toolbox available to the High Commissioner in New Caledonia. It is important to remember that firmness is required”, declared the government spokesperson. What are the limits of the state of emergency? It is planned for an initial duration of 12 days, but may be renewed by a vote in Parliament. As for the consequences on the rule of law, the measures actually taken could above all “pick up on the political signal”according to a specialist.
