Fanny Guinochet: You can ask your boss to pay you money before the end of the month. Two possibilities: benefit from early payment of part of your salary for hours of work that have not yet been worked. It’s The Payday Advance. Or, the salary deposit.
You ask to be paid before the end of the month for work already done. The amount of the advance payment is then calculated based on the hours already worked, before the pay slip is made.
In general, the deposit is paid on the 15th of the current month, and at the end of the month, this deposit is deducted from the amount of the net monthly salary to be paid. Deposit or advance, all employees, whether fixed-term or permanent, can request it, without being obliged to justify your request, that is to say, explain why you need this money.
Can the employer refuse?
Yes, the salary advance, that is to say money advanced for work that you have not carried out, is not a right provided for by the Labor Code, the boss can perfectly well say no , because it amounts to a loan, it is at his discretion.
And the salary deposit?
It is different because it is governed by the Labor Code and your employer is required to accept your request for a deposit, provided that it is your first request this month. And that it does not exceed half of your salary.
However, if you have obtained a first deposit, and you request another, your employer can then refuse you a second time, it is possible to pay the deposit in cash, but within the limit of 1500 euros.
