The overwhelming majority of moments of contemplation and minutes of silence, organized Monday October 16 in middle and high schools throughout France in tribute to Dominique Bernard, the teacher victim of a terrorist attack Friday in Arras, took place with dignity and in respect. 179 incidents were still reported, giving rise to 179 referrals to public prosecutors, announced the Minister of Education Gabriel Attal on Tuesday October 17. Several dozen of these referrals concern “apologies for terrorism”.

This offense, which appeared in the penal code in 1986, punishes the fact of publicly passing a favorable judgment on a terrorist act or its perpetrator. In this case, it concerns the assassination of the Arras professor. Among the incidents reported, a student declared during the tribute to Dominique Bernard: “It’s well done for him, it’s deserved”. Two other students simulated gunshots.
Prison and disciplinary measures
If the qualification as an apology for terrorism is retained, the penalties incurred will be five years in prison, and two and a half years for minors. In fact, depending on the seriousness of the actions and words, young people with no prior record who express regrets risk suspended sentences, community service or repair courses.
The Minister of Education also promised disciplinary proceedings within middle and high schools. For the 68 most serious incidents, he requested the temporary exclusion of the students concerned while awaiting their disciplinary council.
