In what exact circumstances can the police fire if they refuse to comply? Explanations.
A few weeks ago, in Paris, police fired on a vehicle that had accelerated sharply. How does the law define refusals to comply? Most of the time at the wheel, the controlled drivers pretend to slow down, or turn off the engine, before trying to flee or force the roadblock. A misdemeanor punishable by two years in prison. According to the police, refusals to comply would multiply, regardless of the profile of the drivers.
“It can be for different reasons, it goes from the simple lack of insurance or driver’s license, (…) to the highwayman”, details Josias Claude, departmental secretary of the SGP-FO 75. According to the police unions and the Ministry of the Interior, there is a refusal to comply every 30 minutes. A little overestimated, this order of magnitude includes 29,845 offences, including driving under the influence of alcohol. In reality, the number of refusals to comply would be close to 17,000. Since 2017, a new law authorizes the police to shoot in a state of legitimacy defence, to protect other people or defend a place. It is their responsibility to assess the situation, in a few seconds.
