“The vaccine, in general, is an element to protect the population, the applicants do not dispute that, they are health professionals,” pleaded Me Natalia Manole this Wednesday at the Montreal courthouse.

But at the same time, the lawyer delivered a full load to oppose compulsory vaccination for workers in the health network. Because if the government decree comes into force, the non-vaccinated would be suspended without pay, causing disruption of services which would result in “deaths, suffering, postponed surgeries, bed closures, CHSLD”, pleaded Me Manole .

According to her, the decision of the Legault government to force the injection for health personnel thus goes against the obligation “to ensure the protection of the population”, since the suspension of thousands of unvaccinated workers would be. too damaging.

Prejudice

“The prejudice for workers is very important,” added Me Manole. They will have to sell their house, and some will have to leave Canada. They have depression, anxiety. “

Judge Michel Yergeau however recalled that he was not there to play politics or to decide on the merits of the government decree.

“The question here, at this stage, is to decide whether the decree violates the Law on Public Health,” explained the magistrate. If the government has made a bad decision, it will have to answer for it in front of the people, not in front of a judge. “

The hearing is scheduled to last the whole week. A decision will be made by November 15, even if the government decides to delay the date the order comes into force.
