Two men convicted of gang rape in a hotel

A woman from Quebec passing through Montreal for her friend’s birthday lived a nightmare: a man who had accompanied her to the hotel for her “safety” and his accomplice subjected her to a sordid gang rape. The lies of Kervin Legros and John Jamesley Felix did not deceive the judge, who found them guilty of committing a sexual assault in a group.

The victim travels to Montreal on May 25, 2019 to attend his friend’s birthday party. At the end of the evening, the woman is heavily intoxicated by alcohol. Kervin Legros then offers to accompany her to her hotel in the city center. His friend John Jamesley Felix follows him with another vehicle.

In the hotel room, John Jamesley Felix pushes the victim onto a bed and begins to undress her. She struggles, screams and cries to get rid of his grip, but the rapist threatens her: “Stop screaming, stop crying, otherwise we will kill you tonight. »

His accomplice Kervin Legros later enters the room and forces the victim to drink strong alcohol by pushing the bottle into his mouth. His ordeal has only just begun. Kervin Legros then forces her to give him oral sex, while she is penetrated by John Jamesley Felix.

” [La victime] stop screaming and thrashing. She submits to sexual acts so she can survive. She thought she was going to die. [La victime] loses consciousness, ”sums up the judge. When he wakes up, the victim has bruises on his arms, knees and head, and has pain in the vagina, anal, throat and mouth.

According to the judge, the victim gave “credible” and “reliable” testimony, and never tried to “invent things”. His story is corroborated by two independent witnesses. First, the roommate who alerted the hotel after hearing “a woman screaming for help”. Then, a hotel security guard, who notably intercepted one of the men trying to get rid of the bloodstained sheets.

At trial, the two men admitted to having committed a sexual assault with the participation of another person, but disputed the seriousness of their actions, even evoking consensual relations. Kervin Legros, for example, spoke of a “party atmosphere” in the bedroom.

Judge Suzanne Costom slammed the testimonies of the two sex attackers, calling their stories “false”, “implausible” and “unbelievable”. “Both lied”, concluded the magistrate, detailing the multiple inconsistencies and lies in their testimonies.

John Jamesley Felix was also found guilty of uttering threats, while his accomplice was acquitted of this count. They were both acquitted of the count of forcible confinement.

Defense lawyers M.e Vicky Powell and M.e Nadia Jamieson asked for a pre-sentence and sexual report. Me Pierre-Olivier Bolduc led the trial for the public prosecutor.
