The family of the young man who died after the collision with a police car, in Aubervilliers (Seine-Saint-Denis) last Wednesday, and the passenger of the scooter filed a complaint on Monday.

Two complaints were filed Monday March 18 after the collision between two young people on scooters with a police car which left one dead last Wednesday in Aubervilliers in Seine-Saint-Denis. These complaints that Franceinfo was able to consult “are directed against the police officer driving the police vehicle as well as any person whom the investigation will identify as having participated as author or accomplice in these acts”.
In detail, the family of Wanys, the driver of the scooter who died in this collision, filed a complaint against “intentional violence resulting in death without intention to cause it and intentional violence aggravated by the circumstances that the acts were committed by a person holding public authority and with the use of a weapon by destination”.
The passenger, aged 19, filed a complaint with the filing of a civil suit for “intentional violence resulting in permanent disability aggravated by the circumstances that the acts were committed by a person holding public authority and with the use of a weapon by destination”.
The family’s lawyer calls for a change of scenery in the procedure
These complaints with the constitution of a civil party will lead to the opening of a judicial investigation and therefore to the appointment of an investigating judge. But Yassine Bouzrou, lawyer for the family of Wanys and the passenger, requests a change of scenery for the investigation procedure. The lawyer believes that the Bobigny public prosecutor cannot investigate the case due to the “obvious links that exist between the magistrates of the Bobigny judicial court who work on a daily basis with police officers”. Thus, according to him, “another jurisdiction” must grasp these facts.
According to the Bobigny public prosecutor’s office, “all public road videos have been recovered” And “the first operations confirm that the police vehicle had to deviate from its traffic lane, due to a non-respected priority of a vehicle being identified”. This is how the police vehicle “found himself facing the scooter which was coming in the opposite direction at high speed after having disengaged to overtake”. But Wanys’ family believes that the police officer “voluntarily” hit the scooter because it “could have decided to brake hard to avoid the collision”. However, according to Wanys’ family, the policeman “made another decision: to throw the wheel violently to end up in the way”.
