On social networks, some Internet users are worried about a real estate bill that would put an end to private property. Is this really the case?
“THE EStates are planning to abolish private property”can we read on social networks. Internet users refer to the Lagleize law. Proposed in 2019, it is awaiting review. Article 2 provides for the creation of non-profit or public land organizations. Their activity would be to buy and manage land, with or without houses. A private individual could then acquire or build a property on this land, that is to say, become the owner of the walls but not of the ground. It will be rented for a few euros monthly.
The right to property, a constitutional right
But the application of this law would in no way be systematic. Similar provisions already exist but are aimed at a modest audience. The Lagleize law would only extend the system without income conditions, but it would remain limited to areas where the market is in tension. There is no question of questioning the principle of ownership. “We have in our Constitution an article which establishes the right of property as a constitutional right, therefore no law can infringe the right of property”underlines Ganaëlle Soussens, lawyer, expert in real estate law.
