“This group action in anticipation” against BNP “will mark the history of consumer protection”estimated Tuesday January 2 on franceinfo Jean-Yves Mano, president of the consumer association CLCV, while after his conviction on appeal at the end of November in the context of the Helvet Immo real estate loan affair, BNP Paribas found a amicable solution with the consumer association CLCV, which could cost between 400 and 600 million euros.

franceinfo: Are you satisfied?

Jean-Yves Mano: We are extremely satisfied with the solution found. This means that beyond the people who filed a criminal complaint [1 400]the other 3,000 are covered by the amicable agreement that we found thanks to the threat of class action that we filed in 2015.

Do you know when the agreement will be implemented?

This is a relatively heavy file for BNP, each situation is different depending on the amount of the loan, repayments, conflict situations. But by June 30, each subscriber will receive a letter from BNP proposing an amicable solution. The subscriber can call the CLCV for advice and explain why the amicable agreement is in their interest.

Do you think that the class action filed in 2015 pushed BNP towards this amicable agreement?

Of course. This is an agreement in anticipation a few days before the court session of the class action. I think that BNP preferred to take a positive initiative in the name of the interest of all subscribers. This anticipatory group action will mark the history of consumer defense.
