The lawyer for the parents of Chahinez Daoud, murdered by her husband in Mérignac in 2021, Julien Plouton, announces, this Friday, March 10, to France Bleu Gironde that he will launch a procedure for gross negligence against the State. The lawyer points to a series of “dysfunctions of the public service of justice” between the conviction of the suspect for domestic violence on June 25, 2020, and the assassination of Chahinez Daoud ten months later.

On May 4, 2021, Chahinez Daoud, 31, was burned alive in the middle of the street by her husband, when she had filed a complaint for violence a month and a half earlier. Me Julien Plouton denounces in this procedure almost a year “errors, appalling failures and cumulative negligence”.

While imprisoned after charges of domestic violence, and despite the ban, Chahinez’s husband called the young woman 36 times, promising to return to the marital home, says Me Julien Plouton. The victim then decides to file a complaint for the first time, but the sentencing judge is not notified.

One million euros in compensation

According to Me Julien Plouton, when the suspect leaves prison, neither Chahinez nor his lawyer are informed. Three and a half months later, on March 15, 2021, the mother of the family was attacked leaving the supermarket. Her partner forces her into a van, hits her and threatens to strangle her. She therefore lodged a new complaint, doubled the next day by a call to the police. The police issue a search sheet, but the man remains free. During two interviews with his probation officer, he admits having reconnected with Chahinez.

Chahinez’s family lawyer believes that these incidents attest to gross negligence on the part of the state. Me Julien Plouton claims a million euros in compensation, but he ensures that this approach is above all symbolic. He has the impression that since then nothing has changed, referring in particular to the feminicide that occurred last week in Saint-Laurent-d’Arce (Gironde): “We have not yet succeeded in stemming this phenomenon.“, he laments. “Despite the efforts made by the government, despite the allocations in terms of equipment, there is still a lot of work to be done, particularly in terms of raising the awareness of the investigation services, on the responsiveness that must be had in this genre. of the folder”indicates Me Julien Plouton to France Bleu Gironde.
