The wind instrumentalists of the Paris Opera will have to be tested in order to continue practicing

A union had asked for the suspension of the measure imposed by the director general of the Paris Opera which required two weekly Covid-19 tests for wind instrumentalists. The referee-suspension has just been rejected by the Administrative Court of Paris.

Without being able to wear a mask, the wind instrumentalists of the Paris Opera, vaccinated or not, will have to continue to present a negative Covid-19 test twice a week, the Administrative Court of Paris having rejected on Wednesday the summary-suspension directed against this decision.

The Court ruled in favor of the director general of the Opera who had imposed this measure “precautionary” in November “given the now scientifically proven risk of contamination by people who have been vaccinated, of the constant deterioration of the health context“.

Wind instrumentalists cannot carry out their activity wearing a sanitary mask“, which makes “impossible to respect barrier gestures“.

The National Union of Teachers and Artists (SNEA) had asked the judge for summary proceedings “the suspension of the decisions of 19 and 26 November 2021 by which the director general of the Opéra national de Paris imposed the performance of one, then two antigenic tests or weekly RT-PCRs on wind instrumentalists“.

We deeply regret this decision which confirms, once again, that the fundamental rights of employees, in this case the musicians of the Paris Opera, do not weigh very heavily in the face of the health threat.“Victor Steinberg, lawyer representing the SNEA, told AFP on Wednesday.

France is experiencing a meteoric spread of the epidemic with nearly 55,000 cases of contamination per day on average. According to the Minister of Health Olivier Véran, the number of cases will increase and “we will very likely exceed 100,000 contaminations per day by the end of the month“.
