In May 2021, the Constitutional Council censored several articles of the comprehensive security bill, including the use of drones by the police. A few months later, they have just been authorized by the National Assembly and the Senate.

It has been controversial for several months now: the global security law. In this bill, there was in particular article 22 which provided for regulating and authorizing the use of drones equipped with cameras by the police. In May 2021, the Constitutional Council invalidated several articles of this bill, including that on drones, which did not provide sufficient guarantees on respect for private life.

However, despite criticism, drones made their comeback in a new bill in September: the “Criminal Responsibility and Homeland Security” bill. Article 8 of this bill provides in particular for the installation of a new legal framework which would allow the police to use drones to film the population in public places. “It is not infringing on freedoms to be able to fly helicopters with cameras or drones“, said Gérald Darmanin on this subject.

Safeguards have been added: the retention period of data collected by the authorities is, for example, limited. Also, the processing of these images by facial recognition software is strictly prohibited. Claire Hédon, the Defender of Rights, had already criticized this bill for violations of privacy and the right to demonstrate that it could represent. There is still one last step in the National Assembly for this text to be definitively adopted.
