Luis Rubiales was suspended for three years from all activity by Fifa at the end of October 2023, after kissing Jenni Hermoso without her consent during the World Cup victory celebrations.

Luis Rubiales’ appeal was not heard. Fifa confirmed, on Friday January 26, the suspension for three years from any football-related activity of the former boss of the Spanish federation Luis Rubiales, who had kissed player Jenni Hermoso by surprise on the lips after the victory of the Roja in the World Cup final at the end of August.
“After analyzing the arguments presented to him”the FIFA appeal committee “decided to reject” the appeal of Luis Rubiales “and confirm the sanction” who was to him “imposed”, announced the sporting body in a press release. This decision may be subject to further appeal. “before the Court of Arbitration for Sport”however specifies Fifa, which says it is resolute “to protect the integrity of all persons and to ensure that the basic rules of decent conduct are respected”.
The international football body announced on October 30 the suspension for three years of all football-related activities of the former strongman of Spanish football, initially suspended for a provisional period of 90 days.
Request for referral to court by the judge
This news comes the day after another decision in the case, this time from the Spanish courts. THE The judge in charge of the investigation into the scandal requested, Thursday January 25, the referral to court of the former boss of Spanish football. However, this decision can still be appealed and does not guarantee that Luis Rubiales will appear in court.
According to the magistrate who concluded his investigation, the kiss to the number 10 of the Spanish team after its victory in the World Cup, was not “not been consented to” and was “a unilateral initiative, made by surprise”underlines the court of the National Audience. “A kiss on the mouth affects the sphere of intimacy relating to sexual relations”he adds in a press release.
This judge – who indicted Rubiales for “sexual assault” and offense of “coercion” – does not specify in his order the offenses for which he must be tried because it will be up to the prosecution to do so before the opening of a trial.
