The identity check of health pass holders is one of the points of tension in the bill. It would be up to the staff of the bars, restaurants or cinema to take care of this in the event of a proven doubt.

Will he soon have to present his identity papers in addition to his vaccination pass at the restaurant or museum? This is the government’s solution to fight against the circulation of false passes in France. Some restaurateurs reject the idea of ​​additional control. “It’s not my job, I’m not from the police”, says one of them. Customers are divided. “If this is the only way out, I say yes”, says one of them, while another believes that “from the point of view of public freedoms, it would not be good at all”.

Karin Baldisseri, a Bordeaux restaurateur, would have liked to do it earlier. “There are young ladies who introduce themselves and their name is Eduardo. (…) If we could in case of doubt check the identity card, (…) I would find that logical”, explains the restaurant worker. Only the police have the right to demand identity documents, but several professions can ask to see them, such as cinema managers.

The government provides that checks are made in case of doubt, a fragile notion according to a lawyer. “The idea of ​​doubt by definition (…) is subjective. The risk is the use of this objective by people who, subjectively, would like to return this meaning to purely personal ends”, estimates Professor Mathieu Touzeil-Divina, professor of public law at the University Toulouse 1 Capitole (Haute-Garonne).
