It’s a complicated situation. On May 19, a couple signs at the notary the acquisition of a house in Ollainville, in Essonne. When they leave to take possession of it, they discover that the house is squatted.
The Minister of the Interior requests the evacuation of the accommodation
This Thursday, Gérald Darmanin and Amélie de Montchalin, the Minister for Ecological Transition, took the situation in hand. Via a message published on social networks, the Minister of the Interior asks the prefect of Essonne “to initiate the procedure of article 38 of the DALO law for a rapid evacuation of illegal occupants”.
This procedure provides for expulsion by the prefect on three conditions. The rightful owner must “having filed a complaint, proved that the accommodation constitutes his home and had the illegal occupation noted by a judicial police officer”.
Immediate eviction
All these elements are met, a complaint having been registered on June 3, the notarial deed proving that the accommodation is squatted, and the illegal occupation having been noted on June 4.
The family squatting the accommodation was given formal notice to vacate it immediately. The prefect will also examine the situation of the family concerned by the expulsion. She will be taken care of temporarily, the time to examine her situation.
