The Paris prosecutor’s office requested a dismissal on Wednesday as part of the investigation into accusations of rape against the current Minister of the Interior Gérald Darmanin, he confirmed Thursday January 13 to franceinfo, confirming information from BFMTV. It is now up to the investigating judge to order a dismissal or to return Gérald Darmanin to justice anyway.
“We take note of this indictment of dismissal and await the final decision of the investigating magistrate”, commented the lawyers of Gérald Darmanin, Maîtres Pierre-Olivier Sur and Mathias Chichportich at franceinfo.
The investigating judge had closed the investigation into the accusations of rape against the Minister of the Interior Gerald Darmanin on September 9 and awaited the conclusions of the prosecution to render its decision. Gérald Darmanin is placed under the status of assisted witness in this judicial investigation.
Sophie Patterson-Spatz has already filed a complaint twice, in 2017 and 2018, against Gérald Darmanin, whom she accuses of dangling her help to have a conviction reviewed in exchange for sexual favors in 2009, when he was in charge of mission in the legal affairs department of the UMP. In this case, Gérald Darmanin confirmed having had a sexual relationship with the complainant but contests any constraint and any consideration.
The first complaint was dismissed by the Paris prosecutor’s office. The second with the constitution of a civil party, which leads to the almost automatic opening of a judicial investigation, came up against the refusal of an examining magistrate to resume the investigations. But in June 2020, the Paris Court of Appeal ordered the resumption of these investigations. Gerald Darmanin filed a complaint for slanderous denunciation.
