The National Rally files an appeal against the European Pact on Migration and Asylum

The party wants to challenge the procedure for relocating migrants provided for by this pact, France Inter revealed on Wednesday.

Three days before the European elections, the National Rally filed an appeal on Tuesday evening against the application of the European Union’s Pact on Migration and Asylum, which was adopted by the Council of the European Union on May 14 last, reveals France Inter on Wednesday June 5. The party wants to challenge the procedure for relocating migrants provided for by this pact. In the event of strong migratory pressure, the Commission can indeed ask Member States to welcome and provide financial or material assistance to asylum seekers, to better distribute the burden between the States.

The National Rally considers that the European Union exceeds its competences and to contest the application of this pact, used article 88-6 of the French Constitution, which is unprecedented in France. This makes it possible to refer a European legislative act to the Court of Justice of the European Union, on condition of collecting 60 signatures from parliamentarians, for violation of the principle of subsidiarity.

The principle of subsidiarity “defines the conditions under which the Union has priority for action in relation to the Member States”, according to the European Parliament website. Once the signatures have been collected, it is up to the government to forward this appeal to the Court of Justice of the European Union.
