This Thursday, February 10, the magistrates of the investigative chamber of the Aix-en-Provence Court of Appeal canceled the detention of Alain Ferrand.
The elected official had been detained in Perpignan prison since January 25, for non-compliance with his judicial control. He is charged in particular for “organized extortion, embezzlement and complicity in the destruction of evidence” as part of an investigation into illegal taxes allegedly imposed on managers of campsites in Barcarès
For the moment, we do not know the motives of the chamber for this decision to cancel the detention of Alain Ferrand. During his incarceration, his lawyer filed an appeal, for procedural defects.
According to Master Phung, “the arrest warrant for Alain Ferrand was void“from a legal point of view because he did not respect the conditions laid down by law. An arrest following an arrest warrant can only be made”if the person is on the run, or if the person resides abroad“, explains the lawyer.
