This practice is illegal, since the labor code indicates that “the minimum working time for part-time employees is set at 24 hours per week”. To get around the law, the restaurant’s administrative assistant asks the employee to write a letter asking for an exemption.

Even if her contract is only for 15 hours per week, the employee must be available from Monday to Friday, from 8:30 a.m. to 8:30 p.m. The employee must therefore be available 60 hours a week. According to the law, 45 hours of availability can be requested for 15 hours of work.
