The Council of State rejects the request to ban a conference by Rima Hassan on Gaza at Paris-Dauphine

The highest court confirmed on Monday the decision of the Paris administrative court, finding that the risk of disturbances to public order, as feared by the university management, was not justified.

The Council of State finally authorized, Monday May 6, the holding of a conference with the Franco-Palestinian activist Rima Hassan at the University of Paris-Dauphine, which the management of the establishment wanted to see canceled. This decision by the highest administrative court confirms that of the Paris administrative court – whose order was made public on Saturday – which was seized by two higher education unions (Sud-Education and Ferc-CGT).

According to the order of the Council of State consulted by franceinfo, there is nosufficiently detailed elements capable of establishing within the University of Paris-Dauphine the reality of the alleged threats to public order and the impossibility of confronting them.. The legal body therefore orders the university to determine as soon as possible (…) the new date envisaged and the guarantees provided by the organizers on the security and moderation system of the conference”.

Towards a postponement at the end of the month?

The meeting, titled “Acting on the Threat of Genocide in Gaza,” was originally scheduled for Monday. Organized by the Palestine Dauphine Committee, it was notably to welcome Rima Hassan, candidate for the European elections on the list of La France insoumise. At the end of the hearing, she shouted “victory” on the social network “at the end of May”.

The management of Paris-Dauphine had argued the “risk of disturbances to public order” and the need to “guarantee the safety of all” to ban this conference. She further claimed that the theme of the meeting would exceed “the missions of the establishment or would be likely to call into question its neutrality”.

While student mobilizations in favor of the Palestinian cause are increasing, the Minister of Higher Education Sylvie Retailleau asked university presidents on Thursday to ensure “preserve the order” public on their campus. She also asked to “to guarantee” within universities “plurality of expressions”.
