The highest administrative court dismissed the two channels’ emergency proceedings, but will rule on the merits by the end of November.

The Council of State rejected, on Wednesday, September 25, the appeals filed in summary proceedings by the channels C8, NRJ12, not retained by Arcom (the audiovisual regulator) during the procedure for reassigning DTT frequencies, in July. The highest administrative court rules that the emergency condition is not “not filled”.
The radical left-wing web TV Le Média also saw its appeal rejected by the Council of State. But the Council of State specified that these three appeals will be examined in depth by the end of November.
On July 24, Arcom unveiled the list of candidates selected for the reallocation of 15 TNT frequencies in 2025, rejecting those of C8 and NRJ12 in favor of two newcomers, OFTV (Ouest France group) and RéelsTV (CMI Média, owned by Czech billionaire Daniel Kretinsky).
The C8 channel quickly opposed this decision, considering that its situation “is particular in view of the economic, social and competitive issues generated by this decision for a television channel that has existed (…) for almost 20 years”.
The channels selected by Arcom will only obtain their authorization to broadcast after having signed new agreements with the regulator, by the end of the year.
