the Council of State denounces “attacks” against the independence of justice

The examination by the high administrative court of an appeal relating to the wearing of the hijab in women’s football has provoked strong political reactions.

“Questioning the operation [d’un] public service of justice is to attack an essential institution for democracy.” The Council of State denounced, Wednesday, June 28, “the attacks” against her after the avalanche of political reactions to the examination by this court of an appeal on the wearing of the hijab in women’s football, in favor of which the public rapporteur ruled.

In a rare tweak, through a press release published on its website, the highest administrative court declares “reserves[r] the right to sue for insult, defamation, incitement to hatred or threat”. These “attacks” follow the holding of a hearing on Monday before the Council of State, which examined an appeal by the “Hijabeuses” against the French Football Federation (FFF) which prohibits them from playing veiled during competitions.

The Council of State works “in complete independence”

The opinion of the public rapporteur triggered numerous political reactions, some aimed directly at the court. “It takes the naivety of a rapporteur to the Council of State to write that there is ‘no proselytism, that there is no provocation’ in wearing the veil to play football”was indignant the boss of the deputies Les Républicains, Olivier Marleix, who challenged the Prime Minister during questions to the government, Tuesday, in the National Assembly.

The Council of State, for its part, recalls “that the women and men who render administrative justice work every day, in complete independence, and in the strictest respect of the principle of impartiality, to guarantee respect for the law by the administration and respect for freedoms”. Her decision on wearing the hijab in women’s football is expected on Thursday.
