A setback for Viktor Orban. The Hungarian Constitutional Court on Friday (December 10th) rejected an appeal lodged by the government against a decision of the EU’s highest immigration court. She estimates “not be in a position to challenge the judgment of the Court of Justice of the European Union, nor to examine the primacy of European law”. The sovereignist Prime Minister had asked the instance ofe look at a judgment handed down in December 2020 condemning Hungary for violating EU asylum law.

This move came at a time when a judgment handed down in October by the Polish Constitutional Court made certain parts of Community law incompatible with the country’s Constitution. If the EU strongly denounced the Polish decision, Viktor Orban on the contrary welcomed it and called on the European institutions to respect the sovereignty of the 27 member countries of the Union. European Justice Commissioner Didier Reynders deplored the Budapest appeal, calling it“unacceptable”.
