“In a way”the constitutionnal Council “left the door open to the possible return” censored measures “in another text”lamented Friday January 26 on franceinfo Najat Vallaud-Belkacem, president of France Terre d’Asile and former socialist minister. “This is also what the right and the extreme right are already recommending,” she adds.

In total, the Sages of the Constitutional Council censored 32 articles for procedural reasons, and three articles on the merits. For Najat Vallaud-Belkacem, it was “a short, very short moment of relief. It was fleeting because the truth is that it is far from over. The reasons why the Constitutional Council censored a good part of the provisions are reasons of shape”, she explains. “In a way, he left the door open to the possible return of such measures in another text. And this is also what the right and the extreme right are already recommending. It is a real problem. It makes us extremely worried about the future, and angry with the government.”she says.

Measures “remain very problematic”

A large part of the immigration law is therefore repealed, but that will not prevent Emmanuel Macron from promulgating it very quickly. “In this text there remain measures which remain very problematic, particularly for asylum seekers”explains Najat Vallaud-Belkacem. “For example, the single judge at the National Court of Asylum. We know very well that this provides much less guarantee for people to see their case processed in good conditions,” she assures.

The former minister deplores the “spill of xenophobic and racist speech of exclusion” In France. She recalled that “people who come to French territory to request asylum” are “people who are fleeing persecution, conflicts, who have experienced absolutely terrible things”. Even though she admits “that from time to time, there are some who use this path even though they have other intentions and other realities of life”. But according to her, it is about protecting asylum seekers “in the name of our humanity”.

By this law, “we are putting obstacles in their way, making it absolutely impossible for them to turn them into potential delinquents when they have done absolutely nothing,” denounces the president of France Terre d’Asile.
