Following the murder of a student by a man subject to an OQTF, an obligation to leave French territory, the debate on the effectiveness of this measure has been relaunched. “There was a revision in 2024 of the law on OQTFs, that is to say that when an OQTF is decided, its validity is no longer one year, but is three years”explains Randall Schwerdoffer, criminal lawyer, guest on franceinfo Thursday, September 26. “The big problem today is the number of people who are subject to an OQTF and the number of places there are in specialized detention centers”he explains.
Not all people can be controlled and are therefore not subject to judicial supervision. How was Philippine’s murderer, already convicted of rape, able to be released? “The laws may be too lax, not the judges,” Randall Schwerdoffer assures us that under the old system of automatic remission, the suspect, sentenced to seven years, had been in prison for five years.
