The Nantes court gave up, on Monday, a young driver who had tested positive for cannabis while driving, last June, in Saint-Philibert-de-Grandlieu. She was released because, in his case, it was legal.
The release requested by the public prosecutor
This release pronounced by the judge, it is the prosecutor himself who asks for it during his requisitions. Because in this case, if the saliva screening indicates that the young woman is driving under the influence of cannabis, that she has traces of THC, to put it simply, the high molecule of cannabis, she affirms that no she stopped the firecrackers. In particular because it earned him a license suspension three years earlier, she says.
CBD flowers
So she opts for CBD flowers, a non-psychotropic molecule of cannabis, legally sold. The Ministry of the Interior wanted to ban its sale, but the Council of State temporarily suspended its decision at the start of the year.

If, during the screening, the young woman is positive, it is undoubtedly because of a problem of dosage. For the prosecutor, the young woman did not want to consume cannabis but CBD, therefore impossible to condemn her. She keeps her permit, an essential sesame for her work. Before leaving the room, she whispers: “I thought it was legal and once again I got screwed”. She has since quit CBD. Her doctor prescribed her anxiolytics.
