The kingpin Raynald Desjardins will remain in detention until further notice. His appeal for the revocation of his parole, ordered last September, has in fact just been rejected in order to ensure the “protection of society”.
In its decision, including Press obtained a copy, the Appeal Division of the Parole Board of Canada (CLC) considers that the body “has taken into account the case law and the criteria of the Law to come to the conclusion to revoke »the release of Desjardins.
It is recalled that the CLC must always “determine whether it is convinced that a recidivism on the part of the offender before the legal expiry of the sentence he is serving will present an unacceptable risk for society”. “The protection of society is always the preponderant factor in all decisions of the Commission”, insist the commissioners on this subject.
Last May, the parole of Raynald Desjardins, who has been serving a 14-year sentence since 2016 for plotting the murder of aspiring godfather Salvatore Montagna, committed in Charlemagne in 2011, was suspended barely a month after his death. release.
The reason: he was surprised on May 18 in the company of a man he knew at the penitentiary, Jean-Charles Denommé, who was once considered to be a relation of the Hells Angels. The police saw the latter following the kingpin in another vehicle when he had stopped at five different places during the day.
In addition, the commissioners ruled that Raynald Desjardins had adapted his version of the facts as he became aware of the facts observed by the police. He had notably explained that Denommé had never entered his house and added that he did not know that the latter was following him by car, “because he never looks back when he is driving”. However, the wife of the caïd wrote to the commissioners that the man had carried out work inside his house and that it was she who had asked him to follow her husband, because he had not of GPS.
“A high need for intervention”
At the beginning of September, saying they were concerned about his “lack of honesty and transparency” as well as the contradictions and “incongruities” noted in his version of the facts, the commissioners revoked the man’s conditional release.
The latter then appealed the decision; it is this one which has just been rejected. If the Desjardins Case Management Team (EGC) had first noticed that the latter seemed to want to “abandon crime in favor of legality” in order to “make better choices than in the past”, the Appeal Division notes that “the present situation of breach and suspension of your statutory release darkens this picture”. “Your stakeholders are wondering about the real change in attitude and values vis-à-vis respect for the laws that you advocate”, reads the decision, which is addressed directly to the main interested party.
“The sphere of dating always requires a high need for intervention. You still seem to deny your crime of conspiracy to murder despite proof of your involvement as stated in the court judgment. […] You are still identified as being a member of a group threatening security, namely traditional organized crime ”, it is also written.
For all of these reasons, the Appeal Division “considers that the Commission rendered a reasonable decision” based on “relevant, reliable and convincing evidence of [son] case “.
