Rape accusations | French actor Ary Abittan benefits from dismissal of charges

(Paris) French actor Ary Abittan – known in particular for his participation in the successful comedy What have we done to the Good Lord? –, obtained on Tuesday a dismissal of the complaint from a woman who accused him of having raped her, we learned on Wednesday from a judicial source.

This decision was expected, the actor, aged 50, having obtained in July 2023 the abandonment of his indictment pronounced in November 2021.

“I am delighted for Ary Abittan, and I hope that he will finally be able to devote himself to his career, and that cinema will extend its hand to him again,” declared Me Caroline Toby, lawyer for the actor.

For his part, Me Charlotte Plantin, who represents the plaintiff, announced that she would appeal the dismissal.

The young woman, who had been seeing the actor for two months at the time of the alleged facts, accuses him of having imposed sodomy on her while they spent the evening at his house, on October 30, 2021. Aged 23 at the time of the facts, she filed a complaint the same night.

Among the elements which had been “likely to weaken the probative value of the clues initially retained”, magistrates had cited during the investigation the testimonies of Mr. Abittan’s former girlfriends, who described “a respectful partner” and psychiatric and psychological expertise which had not “identified any personality elements favoring deviant sexuality or aggressive sexual impulses”.

These magistrates nevertheless recognized the “indisputable” post-traumatic stress of the complainant.
