A criminal nicknamed “Satan” who shot a father in the head in front of his wife and children was found guilty of first degree murder on Wednesday after a three-month trial. His two accomplices were found guilty of manslaughter by the jury.
“Guilty of first degree murder,” said the president of the jury Wednesday noon, ending seven days of deliberations at the Gouin Judicial Services Center in Montreal. The shooter, Jeffrey Romel Nauzinor, alias “Satan”, remained impassive in the dock. He is automatically sentenced to life in prison without the possibility of parole for 25 years.
Also charged with first-degree murder, Gretzky Marcellus, a rapper named “Flawless,” was however convicted of a lesser count of manslaughter. The third defendant, Omar Araghoune, alias “Pooh”, was also found guilty on this count for which he was accused.
The murder of Osvaldo Pineda Melgar is blood-curdling. The father of the family was shot in the head by Jeffrey Romel Nauzinor in front of his wife and their young children. On a photo filed in evidence, we can see a unicorn stuffed animal on the parental bed. The body of the father of the family then lies in a pool of blood at the foot of the bed. The jurors were able to view the children’s statements during the trial.
This gratuitous murder was probably committed for a drug debt case. Narcotics were indeed found in the apartment of Osvaldo Pineda Melgar in the borough of LaSalle.
According to the evidence, the three assailants arrived at the victim’s house on the morning of September 16, 2019. The killer, Jeffrey Romel Nauzinor grabbed the victim by the hair and dragged him to the bedroom. His accomplice, Gretzky Marcellus hit the victim and asked him where the “stock” was. The third accomplice was not charged with murder since he had remained in the kitchen during this time.
To explain the manslaughter verdict for Gretzky Marcellus, one can assume that the jury was not convinced beyond a reasonable doubt that he knew his accomplice was going to kill the victim during their “joint adventure”. Note that the charge of first degree murder was based on the forcible confinement of the victim, and not on the premeditation of the murder, as is often the case.
To prove the presence of the defendants at the scene, imposing geolocation, DNA and expert evidence was presented by Crown prosecutors Me Nadia Berube, Me Louis Bouthillier and M.e Jasmine William. The defendants did not present a defence. The prosecution said it was “satisfied” with the verdict.
Jeffrey Romel Nauzinor is defended by Me Gunar Dubé and M.e Xavier Desrosiers, while Gretzky Marcellus is represented by Me Jean-Pierre Sharpe and M.e Camille Chabot. Omar Araghoune is defended by Me Alexandre Garel and M.e Louella Giguere.
The parties will return next January for sentencing submissions before Judge Mario Longpré.
