The immigration bill was largely censored by the Constitutional Council on Thursday January 25. Certain measures carried by the right were not retained, judged as not falling within this text of law, what we call legislative riders, while others were judged to be non-compliant with the Constitution. Thibaud Mulier, lecturer in public law at Paris Nanterre University, explains in 19/20 info that most of the censored articles were censored in a manner “procedural”.
Some measures censored on the form
The constitutionnal Council “censors them because a certain number of provisions are not linked, even indirectly, to the initial bill, but that does not mean that it is ruling on the substance”, explains Thibaud Mulier. Therefore, “nothing would prohibit re-inscribing a certain number of provisions in a new legislative vehicle”explains the lecturer in public law.
