42 hotels in Lourdes (Hautes-Pyrénées) appealed to the Court of Cassation at the end of August to obtain compensation from their insurer Axeria after their closure caused by the Covid-19 epidemic, reveals France Bleu Béarn Bigorre.
The dispute has already been judged by the Tarbes commercial court and then the Pau court of appeal. Initially, Axeria refused to compensate these 42 establishments although the hotels concerned had a contract protecting them in the event of contagious diseases and infections.
Up to one to two million euros in compensation
In September 2021, the Tarbes commercial court ordered Axeria to pay the 42 hotels in Lourdes compensation of up to one to two million euros in certain cases, reports France Bleu Béarn Bigorre.
In June 2023, the Pau Court of Appeal ruled in favor of the insurer because the contract clause stipulated that the illness could only concern the establishment.
The hearing at the Court of Cassation will probably be held in May or June 2024 according to the Court of Cassation contacted by France Bleu Béarn Bigorre.
