A request for an interlocutory and permanent injunction was filed Tuesday in the Superior Court of Quebec by residents of the RPA of Mont-Carmel, who wish to keep the operation of the residence as an RPA.
This new legal action asks the Court to order the respect of this commitment to the new owner of the private residence for seniors (RPA), acquired last December by the limited partnership 955 René-Lévesque Est SEC
The owner wishes to terminate the RPA certification of the establishment next July in order to create a rental housing complex. Eviction notices had therefore been sent to residents by January 31, 2022 for this reason.
A 3% increase in rents without existing services, such as the presence of a nurse 24 hours a day, is also involved in this transformation project.

The committee made up of seven residents has already filed 57 applications in opposition to the change of assignment before the Administrative Housing Tribunal (TAL), last February.
The owner was then given formal notice to undertake to maintain RPA’s services and to waive the eviction notices. However, no response was given by the owner.

A petition had also been launched on the site of the National Assembly to demand that Quebec put in place obligations relating to the maintenance of the status of a residence considered RPA.
Remember that two-thirds of the residents of the RPA Mont-Carmel are over 75 years old.
