The Crown will contest singer Luck Mervil’s request to have his name removed from the national sex offender registry.
In 2018, the man pleaded guilty to one count of sexual exploitation, namely having sexual contact with a teenage girl over whom he was in a position of authority. The actions occurred in 1996 in Montreal. The complainant was then a young girl of 17 years old and Luck Mervil was 29 years old.
For his actions, the singer-songwriter (whose real name is Lucknerson) was sentenced to six months in home confinement. But Judge Mélanie Hébert also ordered him to be registered on the sex offender register for 20 years.
Last May, he asked to no longer be subject to this obligation through a motion filed before the Superior Court.
Friday morning, the Crown indicated that the motion would be contested.
However, she does not intend to file evidence to counter Mr. Mervil’s request. Except she wants to cross-examine him. He must still discharge his burden of proof, noted the Crown prosecutor, Mr.e Hugo Rousse.
Mr. Mervil’s lawyers will have him testify in support of his request “on his personal circumstances, his values and his life”, his lawyer briefly summarized before the judge on Friday.
His arguments will be presented before a judge in December.
