Launch of work on the law to protect those whose mental state is dangerous

The Minister responsible for Social Services, Lionel Carmant, announced on Wednesday that he was launching work on the application of Law P-38, which aims to protect people whose mental state presents a danger to themselves or to others.

Mr. Carmant wishes to draw up an inventory of the application of the law in Quebec, 25 years after its entry into force. A public consultation with experts, partners and key players concerned by this subject will also be initiated.

The Quebec Institute for Law and Justice Reform (IQRDJ) was mandated to carry out this work. This will make it possible to have “a solid foundation for better understanding the issues and challenges that persist on the ground, both for those who apply the law and those affected by this law,” the Minister said in a press release.

Bill P-38 allows someone to be hospitalized against their will in order to have them undergo a psychiatric evaluation.
