Jacques Delisle case: the Supreme Court will position itself on Thursday

The Supreme Court will rule on Thursday in the case of former judge Jacques Delisle, who still wishes to overturn the holding of a second murder trial. The highest court in the country will announce whether or not it will take up the case.

The news was announced Monday by the Supreme Court, which will make its decision on whether or not it agrees to hear Jacques Delisle’s appeal.

The ex-judge, now 88, hopes to overturn the Court of Appeal’s decision to hold a second trial for the murder of Nicole Rainville, Delisle’s wife, who died of a gunshot to the head in 2009.

The former judge was found guilty of premeditated murder following a first trial in June 2012, but considering himself the victim of a judicial error, he contacted the federal Minister of Justice. At the end of a long judicial review, Minister David Lametti ordered a new trial in 2021.

It was at this moment, after nine years in detention, that Jacques Delisle regained his freedom.

However, a stay of proceedings was pronounced in April 2022 due to serious misconduct by the Crown pathologist.

This decision was overturned by the Court of Appeal in September 2023 after the public prosecutor appealed the case.

It was following this other reversal that the Delisle clan announced its intention to go to the highest court in the country.

The ex-judge’s lawyer, however, was open at that time to holding facilitation conferences with the crown. The process allows the parties to discuss to see if a negotiated agreement on the outcome of the case can be considered.
