French employees will soon have the right to acquire paid leave, including during periods of sick leave, under a provision of European law which will soon be adapted in France.

It will soon be possible to acquire paid leave even while on sick leave. Until now, labor law did not provide for it, but France is preparing to comply with European law. Clearly, an employee on sick leave will be able to benefit from four weeks of paid leave per year, with retroactivity of a maximum of three years. A relief for employers, who feared that the decision would apply over a much longer period.

The employee must take the process themselves

Originally, the European directive provided for a precedence which could go back as far as 2009. The cost, according to employers, could have been two to three billion euros per year. The measure will have a more limited scope, which the unions consider insufficient. Once the law is published, the employee concerned will have to take the steps to claim their paid leave themselves, and they will only have two years to do so. The text will be examined in the National Assembly from Monday March 18.
