To explain the conviction, the lawyer emphasizes the difference that exists between the tenant of a home and the owner of a condo.
“When you become a co-owner in a co-ownership, you must submit to the declaration of co-ownership as well as the co-ownership regulations,” he explains, specifying that in this case, a provision had indeed been made in order to limit smoking inside the condominium.
Penalties are generally provided for in cases where an owner does not comply with the co-ownership regulations. In this case, however, the dispute between the co-owners went to court. The Court thus ordered Mohammed Mehdi Mokaddem to “repay the Union the sum of $103,695 in extrajudicial fees,” the judgment further indicates. The Court also ordered the defendant to pay the sum of $450 as a penalty.
Thus, although it is legal to smoke tobacco or cannabis inside your home, the situation is different for a co-ownership where regulations prohibit it.
