The management of the Guéret hospital center has disseminated internally a list of unvaccinated staff or those sick with Covid-19, according to the CGT, reports France Bleu Creuse on Sunday, December 5. The Limoges administrative court called the establishment to order on Wednesday 1 December.
In September, shortly before the entry into force of the vaccination obligation for caregivers, the hospital management decided to list the employees of the establishment who had not been vaccinated and those who had contracted the disease. She then sends the document by email to the various department heads of the hospital, but it is distributed too widely and ends up in the CGT’s mailbox at the hospital center.
The union then decides to seize the administrative court of Limoges, for “non-respect for private life, breach of medical confidentiality and discrimination”, explains Emmanuelle Tschirhart, secretary of the hospital’s CGT. For her, “It’s a bit ‘blacklist’, it’s discrimination!”
According to the decision rendered on December 1 by the administrative court, the hospital must stop the distribution of the list. For their part, the human resources of Guéret hospital recognize an error. “This list should never have been released, explains the director of human resources. The compulsory vaccination of caregivers is a novelty for us. “
According to him, this case was not worth a lawsuit, while the establishment is experiencing difficulties. “We have an increase in the number of Covid cases, and we are trying to recruit. This case may be damaging to the hospital”, he worries.
