In Grenoble, in Isère, justice finally suspended the authorization to bathe in a burkini in municipal swimming pools. However, the story is far from over, as the city will appeal.

It is a controversy that swells a few days after the town hall authorized swimming in a burkini in the municipal swimming pools of Grenoble (Isere)the court suspended this order. This decision follows the opinion of the prefecture which is not favorable to the burkini. According to justice, this garment is not close enough to the body and this decision to authorize it would be “communitarian”. The mayor of Grenoble (Isère) has not said his last word and wants to appeal the decision. The Council of State could make a decision, it will have 48 hours to decide.

For justice, authorizing the burkini is an attack on public service by the mere presence of a skirt, “It’s these skirts that make these outfits not fitted to the body. So it is the presence of a derogation from the regulations for strictly religious reasons which justifies this attack on the principle of neutrality of the public service.explains Romain Rambaud, professor of public law.
