Simon Jolin-Barrette lays the foundation stone for his major reform of family law. The Minister of Justice tabled on Thursday a thick bill which aims to better frame the appeal to surrogate mothers and the changes to a sex designation.
This is a first step in the overhaul of family law that the elected representative of the Coalition d’avenir Québec has wanted to initiate for some time. Bill number 2, tabled Thursday at the Salon Bleu, tackles the thorny issue of “surrogacy” in particular.
If passed as is, the legislation would have the effect of “recognizing [re] »This practice and to include it in the legislative framework.
For the moment, any contract concluded between a couple and a surrogate mother is invalid under the law. The agreement between the surrogate mother and the intended parents can therefore be terminated at any time, without consequence.
Simon Jolin-Barrette wants to make up for this delay by tabling the first reform of family law since the 1980s.
The government also wishes to review the legislative boundaries framing gender identity in Quebec. Bill 2 “provides that a person who meets certain conditions may ask the registrar of civil status to add to their birth certificate a mention of gender identity, to change it or to withdraw it and to modify his first names accordingly ”.
The bill tabled Thursday represents the first half of the reform that Minister Jolin-Barrette intends to carry out. The elected representative wants to tackle the issues of conjugality in a second legislative measure to be published, reported Press this summer.
