Following Poland’s statements about national primacy over EU law, the European Commission has launched infringement proceedings against the country.

A few weeks ago, Poland decreed that certain European treaties were incompatible with the Polish Constitution; and that, in fact, national primacy should apply over European law. In order to ensure clear guarantees concerning the judicial flaws in the Polish system, the Brussels-based institution thus attacked the Polish Supreme Court, which challenged this primacy of the European rule of law. While the European Commissioner evokes a court “neither independent nor impartial“, the Polish Prime Minister accuses him of”bureaucratic centralism “.

This will surely be the thorniest issue that Emmanuel Macron will inherit, who will head the rotating presidency of the European Union. Indeed, “LPoles feel frustrated because the European Commission is still blocking the granting of the Polish stimulus fund, i.e. nearly 36 billion euros“, recalls the correspondent in Brussels Pascal Verdeau. Thus, the French president will have to show political ability, dialogue and mediation if he wants to avoid that Poland does not block the signature of the legislative proposals examined during the period.
