Electronic monitoring of employees now regulated in Ontario

Some Ontario workers can now demand to know how their employer monitors them when they are on the job and with what electronic tools.

As of today, companies with 25 or more employees must adopt a policy framing how, when and why management monitors workers electronically.

Employers had six months to draft their policy after the Ontario government passed legislation requiring it last April.

Guidelines were provided by the province and examples of electronic monitoring practices were identified. We are talking in particular about the monitoring of websites visited by employees during their shift or the geolocation of a delivery vehicle driven by an employee.

According to experts, the COVID-19 pandemic has caused the market for worker monitoring technologies to explode given the record number of teleworkers.

The requirement to adopt a policy of transparency on employee surveillance, however, does not create new privacy protections for workers.
