A man who got out of a criminal charge of domestic violence due to endless delays is not done with justice, since his ex-partner has just filed a civil suit for $375,000 for the 13 year old of hell that she says she suffered.
“She believes she was the victim of psychological, verbal and economic violence during the relationship. She also alleges that [l’ex-conjoint] demonstrated judicial violence by suing her for defamation in order to silence and intimidate her,” we can read in the civil suit recently filed at the Montreal courthouse.
However, the case began criminally in the spring of 2021, when an engineer from Repentigny was accused of assault against his partner of the last 13 years.
However, even if the file had been entrusted to the specialized court, that did not prevent things from dragging on, to the point that the maximum deadlines imposed by the Supreme Court had been exceeded.
“We are subject to a situation that is as frustrating as it is uncontrollable,” said judge Joëlle Roy, affirming that she had no other choice but to order a halt to the proceedings.
Post-traumatic stress
The victim, that The newspaper chose not to name due to allegations of sexual violence, then fell into post-traumatic stress.
“[L’arrêt des procédures] devastated the plaintiff and her condition deteriorated significantly,” the civil suit reads.
And as if that were not enough, the ex-spouse had also filed a civil suit for defamation, “so that she does not denounce everything she experienced during the relationship,” according to the woman.
Except that this time, it was the complainant who took the lead, in turn suing her ex-spouse and detailing the abuse she allegedly suffered during their relationship.
Violence
She gives the example of a time when he would have grabbed her by the throat, or once again he would have pushed her against a wall because she would have stuck to wet paint. Added to this are punches and threats, we can read in the court document which also details several alleged sexual assaults, for example while the victim was sleeping, or once again when she had just been hospitalized.
All of this would have had a devastating effect on the woman, who is now seeking compensation for “intentional infringement of fundamental rights guaranteed by the Charter of Human Rights and Freedoms.”
“[Les poursuites civiles pour violence conjugale] are still a new phenomenon, but we are seeing more and more of them in recent years,” commented Me Karina Cloutier of the Rebuilding department of the Legal Services Commission, which is leading the file.
Unless an amicable settlement is reached, the case will soon be presented to a judge. The woman is represented by Legal Aid, as she meets all the criteria for this to be the case.
