Discrimination against the disabled | Nova Scotia will not invoke ‘notwithstanding clause’

(Halifax) The Nova Scotia government says it won’t try to legally override a Court of Appeal ruling that found the province discriminated against people with disabilities the search for accommodation.

Government lawyer Kevin Kindred told a Nova Scotia Human Rights Commission inquiry on Tuesday that the province would not invoke section 6 of the Provincial Human Rights Act.

This article would have allowed the government to argue that its discrimination in housing against people with disabilities could be justified “in the context of a free and democratic society”.

Instead, the government has indicated that it will negotiate a solution to this problem.

The Court of Appeal ruled last year that the government’s failure to provide “meaningful” access to housing for people with disabilities was a violation of their basic charter rights.

The next hearings before the commission of inquiry are scheduled for October 3.
